Terms & Conditions
Full amount of add on including tax must be given before your portrait date and due at signing. It is nonrefundable if you cancel or reschedule. Balance is due the day of your session.
TERMS OF PURCHASE:
I commission COUTURE BOUDOIR to create portraits ordered on the date indicated and I agree to pay for such services in accordance with the terms of purchase. I agree to pay all court costs, attorney fees, and any associated costs involved in the collection of unpaid balances owed to COUTURE BOUDOIR.
CANCELLATION:
The client acknowledges that in the event that there is a Cancellation of the Assignment, COUTURE BOUDOIR will incur expenses and financial loss. Therefore, the Client agrees to notify COUTURE BOUDOIR of a Cancellation at least 10 days prior to the expected cancellation date in order to minimize costs, expenses, and loss of income. Due to the custom assignment and the inability of the photographer to perform other sessions during the time reserved for the Client, the retainer is nonrefundable, Client will not be entitled to a refund if he or she cancels the Assignment. The full balance will be owed if the client does not comply with a ten-day notice of cancellation.
RESCHEDULE FEES:
In the event the Client needs to reschedule, COUTURE BOUDOIR must be notified as soon as possible. The Client understands that rescheduling may result in financial loss for the Photographer.
• The nonrefundable retainer will not be returned.
• A $500 Rescheduling Fee applies to each reschedule.
• The new appointment must occur within six (6) months of the original session date to avoid an additional $300 administrative fee.
• After three (3) reschedules, the contract becomes void, and all prior payments will be forfeited.
• Out-of-state clients will also be responsible for applicable travel fees in addition to the $500 Rescheduling Fee.
NO SHOW:
The client acknowledges if they are more than 30 minutes late to their scheduled appointment their session will be canceled and their retainer will be forfeited and the full balance will be owed. The client acknowledges that in the event that there is a Cancellation of the Assignment, COUTURE BOUDOIR will incur expenses and financial loss. Due to the custom assignment and the inability of the photographer to perform other sessions during the time reserved for the Client, the retainer is nonrefundable, the Client will not be entitled to a refund if he or she is a no-show to the Assignment. The full balance will be owed if the client does not show up for their session.
SESSION POLICY – FEMALE-ONLY ENVIRONMENT:
To ensure a safe, comfortable, and empowering environment for all clients, no men are permitted at your session. This includes, but is not limited to, husbands, boyfriends, male friends, or any other male companions. The studio is a private space designed exclusively for female clients, and this policy helps maintain the discretion and supportive atmosphere that Couture Boudoir® is known for. Clients must plan accordingly and arrive alone or with a female guest if pre-approved by the Photographer.
NOTICE OF COPYRIGHT &USAGE:
All photographs created by COUTURE BOUDOIR are protected under U.S. copyright law. It is illegal to copy, scan, reproduce, or otherwise distribute any images without the Photographer’s written consent. All copyright and reproduction rights remain the sole property of the Photographer unless specifically purchased.
Clients are not permitted to use images for commercial or promotional purposes without prior written permission. If permission is granted, appropriate credit must be given to Couture Boudoir. This includes use on personal websites, social media platforms, and in print or digital publications. When possible, a link to www.coutureboudoir.com is appreciated.
LIABILITY:
COUTURE BOUDOIR is responsible for producing photographs for the planned occasion and in the event of lost, damaged, or undeveloped photos only liable for the total amount paid to COUTURE BOUDOIR. Under no circumstances will COUTURE BOUDOIR be held responsible for any other part of the day’s expenses.
PRODUCT ORDERS:
• Images will be delivered in a private, password-protected gallery available for 30 days.
• All orders must be placed and paid in full within that 30-day window.
• Late orders are subject to additional fees.
• All pre-purchased products are nonrefundable and nontransferable.
• Digital files may be deleted after final delivery. Couture Boudoir is not responsible for archiving client files beyond the contracted order period.
• Album turnaround time may take up to 4 weeks and includes retouching, design, printing, binding, and shipping.
• Basic retouching is included; advanced or extensive retouching will incur additional charges.
• All sales are final.
PACKAGE DELIVERY & SIGNATURE REQUIREMENT:
Client agrees that any products (including, but not limited to, albums, prints, or other physical items) shipped as part of their session package will require a signature upon delivery. This ensures secure receipt of valuable items. The Client is responsible for being available to sign for the package or arranging an authorized recipient to do so. Couture Boudoir® is not liable for delays or additional shipping costs due to missed delivery attempts or unclaimed packages.
STATE TAX:
Applicable state and local taxes will be added to the final invoice and must be paid in accordance with state law.
PAYMENT TERMS:
All payments must be made via accepted digital methods (e.g., credit card, Zelle, Venmo, or PayPal). Credit card payments will incur a 4% convenience fee. Personal or business checks are not accepted under any circumstances. The Client agrees to remit payment using an accepted method by the due date indicated in this Agreement. Returned payments or chargebacks will incur a fee of $150, in addition to any applicable legal or collection fees.
LEGAL AGE: The Client affirms they are at least eighteen (18) years of age. Any misrepresentation of age is considered a material breach of this agreement and may result in legal consequences.
PRIVACY: COUTURE BOUDOIR understands the importance of personal privacy and wants to be certain that we have permission to use or not use images with the expressly given consent of the client. When you are photographed by Critsey Rowe of Couture Boudoir®, certain measures will be taken to keep your photos private. Images will be placed on a professional password-protected website for you to view. All measures will be taken to protect the confidentiality of the professional images taken.
FORCE MAJEURE:
In the event of circumstances beyond the control of either party, such as but not limited to natural disasters, acts of God, illness, or governmental restrictions, where the session cannot be held as scheduled, both parties shall make every reasonable effort to reschedule. If rescheduling is not possible, the liability of COUTURE BOUDOIR shall be limited to the return of any payments received, excluding the nonrefundable retainer.
ARTISTIC RIGHTS:
The Client acknowledges that they are familiar with the Photographer’s portfolio and are requesting services with knowledge of the Photographer’s style. The Photographer reserves the right to edit and release only those images deemed professional in quality and within their artistic standards. No unedited RAW files will be delivered.
DIGITAL FILE STORAGE:
While COUTURE BOUDOIR may retain digital files for a limited period, long-term storage is not guaranteed. It is the Client’s responsibility to download and back up their files upon delivery. COUTURE BOUDOIR is not liable for any loss or damage to digital files after delivery.
